Referral rules

The referral scheme lets you invite people you know to Sakalm. The referrer receives a sum in euros, the person referred receives a gift in the game.
THE ESSENTIALS
• You invite people you know with your code.
• They receive a gift in the game: a Half-Bib or Goldies.
• You earn 20% of their first yearly Premium subscription. Once only per person referred.
• Your commission unlocks 90 days after their payment.
• You can request payment from EUR 25. It goes out on the 15th of the month.
• For people aged 18 or over only.
• Nothing to pay to take part.
• One level only: nothing on the people your referrals refer.
WHERE IT IS OPEN
• Today: in France only. The referrer and the person referred must both live in France.
• In other countries: no referral for now. No code, no referral link, no QR code, no commission.
• You can still invite people you know there, by message, email or social networks. With no reward.
• We will open it country by country, after checking the local rules.
• This document will be updated each time a country opens.
WHAT ALREADY WORKS, AND WHAT IS WAITING
• No subscription is on sale yet.
• The gift for the person referred works: the Half-Bib unlocks on their first activity with its route.
• It depends on no payment, neither theirs nor yours.
• The referrer’s commission can only fall due from the day the subscription is offered.
• The prices below are the planned ones. They will apply on that day if they have not changed.
WHO CAN BE A REFERRER
• Anyone aged 18 or over with a Sakalm account.
• Referral produces taxable income: that is why it is closed to minors. The rest of the app is open from 16.
• The age used is the one given at sign-up.
• An account under 18 has no code. It gets one on the day it turns 18, without asking.
• No sum is asked: no subscription, no purchase, no fee.
• You do not need to be a subscriber to receive a commission.
• A club or a company that has signed with us can be one too, through its own code (see below).
WHO CAN BE REFERRED
• Anyone who creates a Sakalm account and has never had one before.
• From 16: receiving a gift in the game is not joining a paid scheme.
• The link is made by entering the referrer’s code: through the link, through the QR code or by hand.
• During the account’s first thirty days only.
• Once made, it cannot be changed.
• An account cannot refer itself.
• Several accounts for one person: the corresponding earnings are cancelled.
A CLUB’S OR A COMPANY’S CODE
• A club or a company that has signed with us can have its own code, through a link or a QR code.
• Entering that code when you create your account makes the organisation your referrer. Typing it as a promo code on the Premium screen, within the first thirty days of an account that has no referrer yet, does the same.
• You receive the same gift, under the same conditions.
• The organisation receives the same commission as a referrer, paid under the contract signed with it.
• It learns how many accounts arrived through its code and what it is owed. Never who.
• Entering the code does not make you one of its members. Joining an organisation is a separate gesture, described in the privacy policy.
WHAT THE REFERRER RECEIVES
• 20% of the price paid by the person referred on their FIRST YEARLY Premium subscription, tax included.
• Nothing on a monthly or quarterly subscription, nor on the family plan. A person referred who starts monthly and then switches to yearly brings you the commission on their first yearly payment.
• Once only per person referred.
• At the planned rates: EUR 10.00 for a yearly subscription at EUR 49.99, EUR 8.00 for a first year at EUR 39.99 through a partner’s code, EUR 4.00 for a first year at EUR 19.99 during the launch offer.
• During a launch offer, the percentage applies to the amount actually paid, never to the crossed-out price.
• Renewals earn nothing. A second yearly subscription by the same person earns nothing. Shop purchases earn nothing.
• Goldies and Bibs cannot be bought with money: there is no commission on them.
WHAT THE PERSON REFERRED RECEIVES
• A welcome gift, once only per account.
• Either a Half-Bib, or its equivalent in Goldies. The two are worth exactly the same.
• A Half-Bib is HALF a Bib. Two Half-Bibs make one whole Bib, and it is the whole Bib that grants entry to a Challenge +.
• The gift unlocks on their FIRST ACTIVITY WITH ITS ROUTE, validated by the automatic check.
• Counts: an activity recorded with GO, or one that came from a watch with its route.
• Does not count: an activity imported from a file, or reduced to a summary with no route.
• It is not obtained by installing the app, by creating an account, or by paying anything.
• No subscription, purchase or spending conditions the gift, or improves it.
WHEN THE MONEY BECOMES AVAILABLE
• A commission waits ninety days after the referred person’s payment. That is the time Apple and Google take to pay us the money from a subscription.
• From EUR 25 available, the referrer can request payment.
• Payments go out once a month, on the 15th, for every request received up to and including the 9th, Paris time.
• A request made from the 10th onwards goes out on the 15th of the following month.
• Payment is made by bank transfer.
WHEN A COMMISSION IS CANCELLED
• In three cases only: the person referred obtains a refund of their subscription from Apple or Google; they dispute the payment with their bank; fraud is established.
• For ONE HUNDRED AND EIGHTY DAYS from the referred person’s payment. After that, the commission becomes final, whatever happens next.
• A cancelled commission is first taken from what is still pending.
• If it has already been paid out, it is deducted from future earnings.
• We never claim money back from a referrer.
• Every cancellation is notified in writing, with its reason and its date.
• It can be disputed at the address given at the end of these rules. We reply within fifteen days.
WHAT THE REFERRER MUST DO WHEN SHARING
• PUBLIC sharing (social network, audience): say clearly that it is a paid partnership.
• With the words “Publicité” (advertisement) or “Collaboration commerciale” (commercial collaboration), clearly visible, at the start of the message.
• Private message to people you know: no statement is required in France.
• Promise no income. Do not write “earn so much a month”.
• Say nothing false about Sakalm or about what referral earns.
TAX AND REPORTING
• The sums received are taxable income. The referrer declares them themselves.
• There is no exemption for small amounts.
• Above EUR 2,400 received in a single calendar year, the law requires us to report these payments to the tax authorities.
• We then ask for the referrer’s full name and postal address.
• The payment cannot go out without them.
WHAT REFERRAL IS NOT
• There is only one level. Nothing is earned on the referrals of someone you referred.
• No recruitment structure, no tier, no rank.
• No sum is ever asked of a referrer, on any grounds.
• No sporting advantage: no kilometre, no experience point, no place in the ranking, no extra chance at a prize.
CLOSURE AND ABUSE
• An account closed or suspended for cheating or abuse loses its unpaid earnings.
• It can no longer request payment for as long as the suspension lasts.
• Earnings already paid are not taken back.
• Multiple accounts, false identities, buying referral links: all of the referrer’s earnings are cancelled.
CHANGES AND END OF THE SCHEME
• The scheme may be changed or stopped at any time.
• Earnings already accrued on the day of the change remain due, under the rules in force on the day they accrued.
• Any change is announced in the app before it takes effect.
WHO RUNS IT
• The scheme is run by Sakalm, and by Sakalm alone.
• Apple and Google are neither organisers, nor sponsors, nor parties to it.
